Is this a violation?

Sean Spender gives his employer a medical release to contact his physician. The medical release time frame is dated for a 7-day period. The employer leaves a message for the physician on day 6 of that period. The physician does not return the call until 4 days after the release period. Since the physician and the employer speak after the medical release of information expired, do you think this would qualify as a HIPAA violation? Why or why not? Share your thoughts.
