You are engaged in the competitive perfume business and decide you want to protect your intellectual property in an aggressive way. You decide to try to register the odor or olfactory mark of a “balsamically fruity scent with a hint of cinnamon” in the EU. You have the chemical formula as well as a description. You argue that Directive 89/104/ EEC of December 21, 1988, allows registration of “acoustic marks, colors, holograms and other nontraditional marks.” Will this be a successful strategy?
