Case Problem:

Caroline Williams works for a firm that has a written policy prohibiting the use of company telephones for personal use. Employees have been told that the company randomly monitors telephone conversations to enforce this policy. Caroline uses a company telephone to call her doctor to find out the results of a blood test she had taken to determine whether she had contracted a sexually transmitted disease. Her employer intercepted the phone call and, once he heard her question, stayed on the line to find out the results of her test. Discuss why you believe the employer’s behavior is lawful or unlawful. If unlawful, what penalty should he receive?
