Joey Spicoli loves car surfing and rides the concrete waves when he can. Problem is, he does not have a car. On July 1, Joey and his friend Martin I. Maven arranged to buy some marijuana from their dealer Dee Dee Ramone. As it turns out, Joey is Dee Dee's roommate and borrows his car all the time. Dee Dee was busy at the beach, so he gave Joey the keys to his car telling him "The weed's in my desk, Joey. Drive to our place, take the weed and leave the cash in there. Do me a favour, would you? Could you deliver a quarter ounce to Rufus Higgins? When you bring the car back here, just leave the keys in there." Joey got to the car and saw it had a roof rack. Back at their place, he saw Dee Dee's surfboard and decided to tape it to the roof of Dee Dee's car and ride on it. Joey and Martin took the surfboard and some duct tape and taped the surfboard to the roof rack, smoked a joint, and then Joey climbed up on the board. Martin got behind the wheel and started driving around. Martin was totally stoned. He dropped a joint while he was driving and it started to burn his leg. He panicked and jammed on the brakes, sending Joey flying into the windshield of Westley Kinna's oncoming car. The roof rack and surfboard tore off the roof of the car, causing $5,000
damage to the car and destroying the $10,000 collector's edition surfboard. When Westley instinctively hit the brakes, the car behind him, which was tailgating him, slammed into the back of his car. The car that hit Westley drove away right after the collision. Westley has no idea about who owned or was driving the car. The flying glass caused severe injuries to Westley, and Joey suffered a fracture of his femur. Now Westley is suing Joey, Martin and Dee Dee for personal injuries caused by this accident. Joey was off work for 3 months. Joey is also suing
Martin and Dee Dee for his injuries.
