1. Planter left his car on assignment with Baskerville Car Sales to sell it for not less than $10 000; any amount they received above this amount they could keep. After a month Planter asked for the return of his car within three days, or payment of $10 000. The car was returned a week later but it was badly damaged after a collision while being used by employees of Baskerville without permission. Planter refused to accept the car, and demanded $10 000. Will Planter succeed in his claim?
