CHILD PROTECTION IN CYBERSPACE: You have been asked to investigate and make recommendations regarding ethical, compliance and legality issues of a company named LFC, Inc. LFC is a relatively new company in the e-commerce industry. LFC is a web hosting organization claiming to he a full-service provider of mobile websites and/or social media network pages. LFC's services include creating e-commerce sites for businesses interested in offering their product and/or service in an on-line market. LFC offers services such as creating websites intended to allow a business to promote its organization, sell its goods and/or services, conduct business transactions and connect and communicate with customers, clients and other businesses.

A number of different businesses across different industries have already retained/engaged LFC to create and host websites for their respective businesses. One such business is "Young-Investors, inc.". LFC created the website approximately 18 months ago and has been hosting it for Young-Investors, Inc. ever since. The website targeted children and teens using schemes such as contests and prizes. In addition the website was hosted under a number of different names intended to attract children and teens. Furthermore, the site included graphics and cartoons directed at children and teens. "Children" were identified as anyone under the age of 13, and "teens" were identified on the site as anyone between the age of 13 and 17. At one point LFC created a survey called "The Young Investor Measure Up". The survey's introduction stated, "All of your answers will be totally anonymous". The survey then collected information which included, but was not limited to the amount of allowance the child received, whether the child kept his/her allowance or what he/she did with it, gifts the child received such as cash, savings bonds, stocks, etc, the child's spending habits, whether the child/teen had a part-time job, where the child attended school, and the child's current grade level. In addition the on-line survey asked questions about the child's plans for college, and the family's finances.

The survey ended with a request for the name, mailing address, date of birth and e-mail address of the child/teen. It stated that the information would be used to send a newsletter and award a prize every three months. However, no newsletter was ever sent, and no prizes ever awarded.

You are to formulate a hypothesis regarding whether or not the website created by LFC for Young-Investors, Inc. was legitimate, and free of legal issues. Take a position, and state it the form of a hypothesis, and then test the validity of your hypothesis citing case law, statutory law, codified law, and other that supports or contradicts your hypothesis.
