Respond to the following hypothetical by preparing an outline for low value commercial speech for each of the three parties: Viable Co., Cable TV Co., FCC (Government).
Federal law authorized FCC to issue regulation barring ads for products to treat sexual dysfunction on TV, cable TV and telephone except between the hours of 10:00 p.m. and 6:00 a.m. The purpose of which is to prevent children from viewing these ads and related sexual references.
Viable Co.:
1) Published ad on internet and with TV feed worldwide through satellite channels, stated: "Viable will save your marriage and your sex life. Viable works. Call your doctor today and enjoy tonight" followed by a voice warning of possible side effects or unwarranted reactions to Viable, including explicit references to sexual functions.
2) Viable also instituted a special dial online program to call potential customers on cell phones and if answered played a tape of the same ad.
Doctor: Cable TV - Local Channel
Doctor appeared on local cable channel Public Access show on reproductive health airing at 9:00 - 10:00 pm in which doctor referred to sexual dysfunction and discussed the effectiveness of various products, including Viable.
