Obtaining a legal search warrant


Problem:

Robinson has two kilos of cocaine which he keeps in a safety deposit box under his name. The police find out about the drugs, obtain a legal search warrant, and open the box. Robinson is charged with Possession of Narcotics. He argues that he could not have "possessed" them because he was 5 miles away when the box was opened. Is he right and why or why not? He is right - He cannot be convicted of Possession because he did not actually have the drugs. He is right - A person must be "close" to something in order to possess it. He is wrong- He had "constructive possession" since he was the only person who could get into the safety deposit box. None of the above
