1. Is an arrest a "search" or "seizure" (or both) under the Fourth Amendment? Explain your answer. What are the elements of a "reasonable arrest?" What is "probable cause"? What are the different ways probable cause can be established? When should an officer have to obtain a warrant to arrest someone? Are there exceptions to when an arrest warrant is normally required, and if so, explain them? Earlier in the term we spoke about "discretion." Describe how discretion is applied by an officer with respect to an arrest.
