To discourage tobacco use, federal law required all cigarette packages manufactuerd ro sol din the U.S. to bear color graphics depicting negative health consequences of smoking. The statute madates that new warning labels comprise the top 50 percent of front and rear panels of cigarette packages and 20 percent of the area of each advertisement. Pursuant to this authority, the Food and Drug Administration (FDA) selected nine images that would accompany the statutorily prescribed warnings. These inlcuded images of cancerous lungs and dead bodies. Tobacco companies challeneged the rules, complaining that the governement had no evidence indicating that the graphic images would actually curtail tobacco use.
