‘There can be no doubt that both article 30 TFEU and article 110 TFEU are absolutely essential for securing the free movement of goods. However, the Court of Justice has pushed the prohibitions in these two articles too far by limiting the ability of Member States to adopt their own fiscal measures to a much greater extent than is necessary. The Court must radically change its approach.'
