Problem: The City of San Diego v. Roe case,102 provided at the end of this chapter, explores the controversial topic of regulation of private activities away from work. In this case, the employer, the San Diego Police Department, believed that an officer's off-duty activities reflected poorly on the department and therefore were entirely inappropriate. A critical component of the case was the fact that the officer's activities incorporated elements of his duties as a police officer. As you review the case, try to imagine where you would draw the line between appropriate and inappropriate behavior and whether you would have found the employer's actions proper, even if no such incorporation of police activities had been involved.
