Judicial Review is concerned with the decision making process because it examines or focuses on how the decision was made, and therefore determines the legality of how the decision was reached or concluded. However, judicial review does review whether or not the decision made is deserving of the punishment or reward” (Halliday, 2004, p. 188). “The Constitution appoints judicial power to the supreme courts. Marbury v. Madison formed the principle of judicial review of legislation in accordance to the Constitution” (Szypszak, 2011, p. 19). Is there ever a time that it should focus solely on the decision?
