Jane Doe has been employed as a Trooper with the Highway Patrol for the state of Maryland for the past 3 years, assigned to the dispatch desk. On 3 different occasions during the past year, she submitted applications for promotion to the rank of corporal which would result in patrol car duties. Corporals must have a high school diploma and two years in grade as a trooper. Jane meets these baseline requirements. The promotion also requires candidates to pass a written test and successfully complete a “scored interview” that is conducted by a review panel of 3 captains. During her interviews, the captains indicated that, out on the highway, troopers must have a certain “swagger” and asked how a petite little lady like Jane could possibly project the “dominating image” that is essential during a traffic stop. After the third interview one of the captains suggested to Jane that “in order to get out on the highway you are going to have to be more aggressive and project a more “manly” image.” Each of the three vacancies that she applied for was filled by a male and Jane knows of only one female who staffs a patrol car. Jane wants to file a charge of discrimination with the Equal Employment Opportunity Commission. Conduct research on the EEOC process and discuss what you would include in the charge.
