It may seem that we constantly hear about defendant's pleading not guilty by reason of insanity a lot on the news but the requirements to actually plead this way are very stringent. Some people may think that the defendant is only pleading this way not because they are or were truly insane but because they think they can get away with it. In order for a defendant to plead guilty by reason of insanity they must go through rigorous evaluations and tests, each is different depending on the State prosecuting the case. It is not as easy as it may seem or one would think to just say they were insane at the time they committed the crime. In the case of State v Stu Dents, we have researched what the requirements are in the state of Virginia for one to plead guilty by reason of insanity and we have also determined whether we feel as though Stu Dents is competent to stand trial.
