Indicating a request for consideration

Problem: In contract law, words of condition in a promise may indicate a request for consideration. In Hamer v. Sidway, for example, the forbearance of a legal right by the nephew at the request of his uncle was enough to meet the requisite consideration. If a court finds a condition as insufficient consideration, which of the scenarios is most likely?

1. A friend promised to pay for a service rendered yet did not.

2. An art gallery owner agreed to a 3% commission if the artist sold more than 10 of their paintings when the industry standard was 15%.

3. A billionaire told her secretary's son that she may donate to a charity of his choosing if she could pet his dog.

4. An arbitrator agreed to mediate a dispute only if the parties involved were available on a Sunday even though he knew one of the parties had been called into work that day.
