Defendant was a truck driver for North American Van Lines. He picked up 105 refrigerators in San Diego, which he was to transport to Hartford, Connecticut. Defendant stopped in Las Vegas, Nevada. He called Russell, the owner of an appliance store, and offered to sell the refrigerators. Russell informed the police. Defendant and Russell discussed the sale of the refrigerators. Defendant left the store and returned with his truck. He broke the truck's seals, entered the rear, and opened two cartons to show Russell the refrigerators. Russell examined the two refrigerators while defendant rearranged the boxes in the truck. Defendant and Russell went back to the store and tried to commence a deal. They were unable to reach an agreement. Defendant started to leave the store and was arrested. What crime was defendant charged with and why should or should not he be convicted
