Lynn is employed as a bank teller at USA Bank, who employs over 500 people. She was recently diagnosed with bone cancer and as a result has learned that she will need to take about four months off of work for some specialized treatment out of town. Lynn is a 40 year old woman of African American descent.
Prior to her diagnosis, her superiors had been considering firing Lynn for what they consider to be poor performance. Lynn recently approached the Human Resource office to tell them that she will be taking this medical leave.
Her superiors think this may be the perfect time to make their move and fire her. They have asked you, to advise them on how to proceed.
Write a memo to her superiors that does the following:
- Identifies and summarizes the legal/regulatory issues that the bank should be aware of as they address this situation, being sure to note why these regulations are applicable in this case.
- Advises the bank on the next steps that should and should not be taken as it relates to Lynn.
