However, when the officer approached the vehicle, she noticed a marijuana cigarette in plain view that appeared to have been recently lit. During a consensual search, the officer discovered three bags of marijuana inside the armrest. Austin was arrested and charged accordingly.

During the offender's initial appearance, the prosecutor indicated that the offender could be eligible for a first-offender sentence if he plead guilty. Austin plead guilty and was sentenced to 2 years probation. Within the 6th month of his sentence, his probation was revoked because of noncompliance with his probation officer.
