Consider a paper by Carlsmith, Darley, and Robinson (2002) reports evidence that when students are asked, in hypothetical crime scenarios, to decide what punishment would be appropriate, they base their decisions almost entirely on "just deserts" (the worse the crime, the more deserving of punishment), and do not take into account the degree to which the punishment would act as a deterrent. If, for example, punishment A would be much more likely to act as a deterrent than punishment B, but punishment B seems more consistent with the "badness" of the act, then students will opt for punishment B.
