How can we know the intent of the perpetrator

Problem

Some legislation defines harassment or aggression, in part, by focusing on either the intent of the perpetrator (e.g., behaviour that is intended to annoy or embarrass) or the reaction of the victim (e.g., behaviour that is unwelcome). Does this pose a problem for regulation? How can we know the intent of the perpetrator or the anticipated reaction of the victim?
