Assignment Part 1: The Report

Problem 1: You are approached by a friend, Sharika, who manages a local shoe store in Toronto. She explains to you that she is working very long hours (50 to 60 hours a week) because she does everything in the store - hiring, firing, preparing shift schedules, serving customers, etc. She is paid an annual salary. At the time she was hired, Sharika understood that there would be no additional compensation for overtime but now she does not think this is fair. Sharika wants to know if her employer has to give her overtime pay. Is Sharika entitled to receive overtime pay in these circumstances?

Problem 2: Your boss has come to you and explained that he has just finished a performance evaluation meeting with an employee, John. John became very upset during the meeting and at the end of it he got up and shouted: "Okay, if that's the way you feel about me, I quit!" Your boss is delighted with the resignation because John has been a difficult employee from the time he was hired three years ago, and he wants you to look for a new employee to replace John. What advice would you give your boss?

Problem 3: ABC Company has decided that it needs to make significant changes to its benefits package to cut costs in an increasingly competitive marketplace. It wants to know the best way to introduce the changes so that employees will respond positively and so there won't be any legal problems. It has approximately 50 employees. How would you advise this employer?

Problem 4: XYZ Inc., an Ontario medium-sized company with a payroll of approximately $3 million, is downsizing and needs to dismiss between forty-five and fifty-five people, Including Phil a mid-level sales manager. Phil earns $85,000 per year and has been with the company for six and a half years. Explain the Employment Standards Act (ESA) minimum requirements with respect to Phil's dismissal. Note that you are only calculating the "minimum requirements" set out In the ESA. As we will learn, the amount owed when dismissing an employee Is often much greater than that minimum.

Problem 5: Alan, who is 18 years old, applies for a job as a clerk in a sporting goods store In Ontario. The store manager is impressed with Alan and says that he would like to hire him, subject to reference checks. Later, the manager calls Alan to say that he will not be hired. On checking his references with a former employer, the manager found out that Alan was recently convicted of careless driving under Ontario's Highway Traffic Act.

(a) Has the store manager violated Alan's human rights by refusing to hire him?

(b) Would your answer to (a) change if Alan was only 17 years old?

(c) Would your answer to (a) change if the job involved picking up and delivering sporting goods?

Problem 6: An employee with a history of back problems has applied for a posted job that requires some heavy lifting. The employer is concerned that the employee may be physically unfit to perform the job and could injure himself further. Explain what the employer should do to comply with the law.

Problem 7: A good friend of yours, Alina, got a job with a coffee shop about a month ago.

Before Alina accepted the job, she was told that her hourly wage would be $17. But when Alina started the job, a few days later, she was handed a "standard written contract" which stated that her hourly rate would be minimum wage. She wasn't happy, but she just signed the contract and began work. The situation has really upset her - she tells you that she thinks the law is unfair - that she only signed the contract because she really needed the job. What would you tell her in return?

Your company has hired outside resources to conduct morning seminars for the management on various human resource topics. Your boss has read through the materials and while it seems to give all the relevant facts, he thinks the managers will find it too BORING. So, he has asked your team to create a 15-minute presentation on an important portion of one of those various human resource topics to present to the managers after the seminar to grab their interest in the topic and cement their understanding.

In other words, one of my class lectures was the morning seminar... you are creatin' a 15-minute presentation that would immediately follow the lecture to summarize and test the managers understanding of an important part of the lesson. Do not use an online question tool (such as Kahoot) or an online game (such as Jeopardy, Who Wants to be a Millionaire or Family Feud), instead be creative ... skits, songs ...
