Question 1:

Sandy is the newly elected chair person of Eastern Hotel Staff Union (EHSU) which represents 70% of workers of the Eastern Hotel. EHSU is registered and holds registration certificate from the Registrar of Associations.

But, Eastern Hotel has refused to recognise EHSU as bargaining agent to negotiate for a forthcoming collective agreement.

Advise Sandy as to the procedure she must follow as per the provisions of the Employment Relations Act 2008 for EHSU to obtain recognition as a bargaining agent.

‘There has been considerable development since the Industrial Associations Ordinance of 1938, which provided the first piece of comprehensive framework for Industrial Relations in Mauritius.’ Explain.

Question 3:

The Industrial Relations Commission which existed under the repealed Industrial Relations Act has been renamed the Commission for Conciliation and Mediation under the Employment Relations Act 2008.  Explain the constitution, the powers and functions of Commission for Conciliation and Mediation.
