Prosecution followed the accident to two (2) employees who were burnt when flammable solvent fumes were ignited by the electric sander whilst removing paint from in a confined space in the small yacht under repair. There is a high potential for serious damage for those working in the confined space with the flammable solvents. An investigation showed the employer failed to:
1. Perform risk assessment for entry in the confined space
2. Give a safe system of work for cleaning paint in confined space
3. Choose appropriate work equipment for employ in a flammable atmosphere in a confined space.
4. Make sure the safety of employees working in confined space
