Problem

An employee was terminated; the reason given was that she had failed to meet her sales quota. She believes the actual reason is that her child is seriously ill and undergoing expensiv medical treatments. She claims her supervisor made remarks about the costs of the treatments and their impact on the employer's medical insurance costs. The employer is self-insured for part of their benefits (which means the employer, not their insurance company, is responsible fully for these costs.) She also is aware that there are sometimes accommodations made in a workplace due to medical conditions. Does the employee have a claim? Explain your reasoning and your opinion on who would prevail.
