Problem: In January this year, while visiting Singapore, Cyrus a famous Japanese Pop singer, signed a contract with FatCat Productions to perform a 2-night solo concert event in April this year. The $50,000 contract stated that Cyrus had to be present in Singapore 3 days before the event to meet fans at various reception. However, due to a nasty bout of food poisoning, Cyrus was only able to reach Singapore 1 day before the concert. FatCat refused to continue with the contract and claimed that the contract was terminated.
By applying the relevant case law, STATE and EXPLAIN whether Cyrus would succeed in suing FatCat for breach of contract, for terminating it without cause.
