There is an old debate about the court's role in rule making, called judicial lawmaking. There are pros and cons to judicial lawmaking. Some groups will say that lawMAKING is not the role of the court, it is judicial review, while others will say that making laws are a necessary part of the judicial process.

First, find an example of Supreme Court judicial lawmaking. Next, describe the lawmaking that came from the case. Finally, discuss whether you agree or disagree on the lawmaking outcome of the case. If you agree, explain why it was important for the court to make the rules and not rely on the legislature. If you disagree, explain what rote the legislature should play in the rulemaking, instead of the court by describing the process that should have occured.
