Problem

Mrs. Smart has contacted our offices concerning an injury sustained by her 9 year old daughter, Stephanie, 2 weeks ago. Stephanie was at a friend's house and the kids were swimming in the backyard pool. Stephanie cut her foot on a drain cover which was not lying flush with the pool bottom and she was taken to the hospital where she received treatment, including 12 stitches to close the wound. She has been told it will leave a scar. Stephanie is currently working part-time as a model and Mrs. Smart believes that the scar will have an impact on Stephanie's career and so wants to sue the owners, Jack Black and Laura White.

Mrs. Smart is concerned that the injury sustained by her daughter will have an impact on her daughter's modelling career due to the scar that will remain. She believes that the pool owners, Mr. Jack Black and Ms. Laura White, are liable for the injury and has therefore decided to sue them. Stephanie was swimming at her friend's house when she sustained the injury, and was immediately taken to the hospital for treatment, including 12 stitches.

a) Provide your reasons as to why you agree with the judge decision that Mr. Jack Black and Ms. Laura White, are not liable to the injury.

b) Explain the case brief in layman terms which your client will understand and set up an appointment time to meet and discuss further action.
