During voir dire, the parties, through their attorneys, select those persons who will serve as jurors during the trial. The parties are prohibited, however, from excluding potential jurors on the basis of race or other discriminatory criteria. One issue concerns whether the prohibition against discrimination extends to potential jurors who have physical or mental disabilities. Federal law prohibits discrimination against an otherwise qualified person with a disability when that person could be accommodated without too much difficulty. Should this law also apply to the jury selection process?
