Question: Downing purchased a TV set from Wood Radio and TV Service and put $100 down on the purchase price. He agreed to pay the balance and take the set when his new home was finished. When Downing went to pay the balance and accept delivery of the TV set, he was informed that the set had been sold to a third party. Can Downing purchase another TV set elsewhere and sue Wood Radio and TV Service to recover his down payment and any difference in cost of the TV set? (Downing v.
