Does subsequent death and pending legal issues

Problem: We have had a few major criminal cases locally that involve high profile individuals. These cases include the criminal trials of Whitey Bulger and Aaron Hernandez. Given the verdicts received and subsequent deaths of both of these individuals, what rights should their attorneys (Jay Carney & Jose Baez) have to begin writing books about these cases? Can these attorneys agree to have these rights as part of agreeing to represent these individuals? Does their subsequent death and pending legal issues (e.g. Hernandez pursuing the Patriots for unpaid salary and Whitey Bulger's family suing the federal prison) influence your opinions?
