Assignment: Non-Democratic Constitutionalism
Length: 1,500 Words.
Write an essay of no more than 1500 words (including footnotes, but excluding bibliography) on any one of the topics below. Note that your answer will be graded on your ability to construct and execute an argument based on the themes developed in class lectures and the articles read for class. You are free to do independent research, but you need not do so.
1. Can you think of any ways to improve existing tools, in either comparative constitutional law or international law (or both), to protect against or prevent democratic erosion and the creation of authoritarian or competitive authoritarian regimes? If so, what are those ways, and why do you think they may work?
2. Do any of the theories and evidence studied for this class have relevance to the contemporary Israeli context? If so, which ones and why? If not, why not?
3. Why has the use of legal and constitutional methods become so important to modern authoritarian projects around the world?
