Problem
Although the United States government has often been referred to as a constitutional democratic republic, some scholars contend that the US government is more of a republic than it is democratic. That is, while the US government may, in may ways, be a government that is run for and by the people, there are actually a number of constitutional provisions within the US government that works against democratic governance. One example of an undemocratic provision in the US Constitution is the inclusion of the 3/5th Compromise in determining how much a slave is counted as a member of the US population.
This brings us to the US Supreme Court which comprises of members (i.e. Justices) who are not popularly elected. Rather of getting elected to serve on the Supreme Court, elections. members are instead appointed by the US President and confirmed by the US Senate soon afterwards to life terms.
The power of the US Supreme Court has also grown, as especially evidenced by the very recent slew of landmark decisions rendered by the US Supreme Court in 2022. Examples include but are not limited to the case of Dobbs v. Jackson Women's Health Organization (2022) which reversed Roe v. Wade (1973) on legalized abortion. Another example is New York State Rifle & Pistol Association v. Bruen (2022), which struck down a New York State restriction on on a person's ability to carry concealed firearms in the state of New York. Quite a lot of power accumulated over time to a branch of government that is not popularly elected.
Do you believe that the process of becoming a member of the US Supreme Court (or even a lower federal court) should be more democratic? Explain. Discuss the degree to which your answer may have been influenced by the very recent rulings by the Supreme Court on cases such as, but not necessarily limited to abortion and/or gun control.
