Discuss about judiciary branch of government


Problem:

How would you respond to this discussion: Judicial review gave the Judiciary Branch of Government the ability to review actions enacted by the Executive and Legislative branches to determine the constitutionality of such actions. If the action is ruled unconstitutional, the action is null and void. This power is consistent with the checks and balances system of our government. Each branch of government has specific checks by another branch to prevent one branch becoming too powerful. In Marbury v. Madison, the Supreme Court was called upon to determine the constitutionality of President Jefferson's withholding of Marbury's judgeship commission by ordering Secretary of State Madison not to deliver the final four commissions. The Marbury suit was filed in 1801, but no decision was made until 1803 due to the manipulation of the court's term (Hall & Feldmeier, 2024). It would be hard to use Judicial review to "reign supreme" or as a power play because of the way our government is set up. I believe that judicial review plays a crucial role in our judicial system as it provides a second look at actions taken by the Executive and Legislative branches of our government and supports the Constitution as the ultimate law of the land.
