Problem:

Joey is a young, hard working white male who has just gotten a new job as a filing clerk at Acme Afro-Sheen Skin Care Company. He works at the company headquarters in El Diablo, New Mexico. Not only was Joey one of the few men who worked in his unit, but he was also the only white person in this unit. Often Joey would have problems communicating with fellow employees. He spoke only English and the black women who worked around him seemed to have a language of their own. Also, several women in his unit were Hispanic and only spoke Spanish to each other. The black women did not seem to mind since all of them could speak Spanish also. After a couple of weeks, Joey realized that when he heard laughter, the women were often looking at him and were saying something in Spanish. Some made "funny looks" with their eyes. After a month on the job, Joey's supervisor called him in and informed him that since he did not quite "fit in"; he was being transferred to their research unit in Juli, Alaska above the Arctic Circle. Joey has called you at the EEOC and wants to know if he has to take the transfer or whether he can sue for some reason (and win).
