Quite recently, the Supreme Court ruled that the ban on same sex marriage by states was unconstitutional because of the 14th Amendment, the 14th Amendment is known as The Equal Protection Clause. It prohibits any state from denying any person within its jurisdiction. the equal protection of the laws.
