The Ontario government wants to widen Highway 400. There are five road construction companies in the region qualified to bid on the project. Three of the five companies want to negotiate an agreement where only one company will bid and then the work will be divided amongst the three contractors if the bid is successful. The bid will not disclose the fact that they are working together. Can the three companies do that? Why or why not? Define and explain any legal concept you use.
