Cynthia Rogers has filed a sexual harassment complaint in federal court against her employer, Galaxy Realty Company. Galaxy has offered to settle this dispute through private arbitration and to pay all the costs for the arbitration, including Cynthia’s attorney, if Cynthia would dismiss her claim in federal court. Cynthia, after considering Galaxy’s offer for private arbitration, has rejected it. After rejecting Galaxy’s offer, Cynthia learned that the federal court in which her complaint was filed has court-annexed arbitration and that her case comes within the guidelines for arbitration and will more than likely be sent to court-annexed arbitration. Galaxy has renewed its offer for private arbitration. Should Cynthia now accept Galaxy’s offer or would she be better off to let the court process proceed to court-annexed arbitration?
