Critique one of the tort protections


Problem 1: Looking at the Fitzgerald v. Salsbury Chemical, Inc. case, what actions, if any, do you think the employer should have taken to avoid a lawsuit? Explain.

Problem 2: Looking at the Cockram v. Genesco, Inc. case, what can an employer do to protect against defamation actions when investigating misconduct and later terminating an employee? Explain.

Problem 3: Is the public policy exception a workable solution to concerns that certain employer activities raise? Should the law find uniform, concrete solutions to these problems, especially since the definition of "public policy" can - and does- differ from state to state?

Problem 4: Critique one of the tort protections we discussed for employees against employer behavior, addressing at least the following: Does it protect employees adequately? Do they protect employees too much? Is the scope of protections available appropriate, or should we strike a different balance between employer rights and employee rights?
