Attend a NSW Court. (Not a Children's Court or Family Court)

Observe and report on the court system by visiting a court where a Criminal matter or a Traffic matter is being heard.

Identify the following in a report:

1. Date and place of the hearing.

2. Name of the accused person from court list.

Travis chan( 19 years old) and geoffrey davis,

3.Name of the Magistrate or the Judge from court list.

Presided over by Mgistrate Sinclair

4. What is the court matter about?

This matter is a joint case where the accused Mr. Chan and davis both have assualted a victim at the local pub.

5. Is the accused person represented by legal counsel?

Both the accused were represented by legal counsel who sought to have the punishment in line with deterrence and rehabilitation themes.

In you short report of your observations,try to include the following detail:

  • Could this matter have been dealt with in another way? Donnna help --- ahah
  • Is the interaction between the Magistrate/Judge, the Police Prosecutor (Local Court) Crown (District Court) and the Defence Counsel appropriate in terms of their responsibilities?
  • Did the accused person appear to understand what was happening? 
  • Did police give evidence in an appropriate and 'disinterested' manner?
  • Using the 'The Rule of Law' definition by Dicey assess whether or not the court process could be improved.

An assault is any act which intentionally-or possibly recklessly-causes another person to apprehend immediate and unlawful personal violence. Although "assault" is an independent crime and is to be treated as such, for practical purposes today "assault" is generally synonymous with the term "battery" and is a term used to mean the actual intended use of unlawful force to another person without his consent. On the facts of the present case the "assault" alleged involved a "battery."
