Could the implementation of an affirmative action plan


As Chief Executive Officer (CEO) of Carter Branchcomb, LLC (the “Firm”), I have discussed with the Management Committee a concern regarding the need for an Affirmative Action Plan. The Firm is aware that many of our competitors have been involved in litigation concerning discriminatory employment practices. The Firm desires to be proactive in this area and avoid, if possible, any negative publicity and reputational risk that may result from an allegation of discriminatory employment practices. Additionally, the Firm wants to avoid the cost and expense of litigation including any final judgment award. As the responsible HR officer for the Firm, please advise me in writing with respect to the following question: Could the implementation of an Affirmative Action Plan negate a claim for “reverse discrimination”? Explain in detail.
