José Iglesias is an employee who works as Accountant I in the finance area of the Department of Correction and is part of a union. As part of the changes to face the government fiscal crisis, José is transferred under the concept of mobility to the Accounting Division of the Department of the Treasury, specifically, to the budget area of government agencies. Jose will perform, to a large extent, the same functions that he performed in the Department of Correction. In addition, José will receive a salary identical to what he received in the Department of Correction. However, his pay is lower than that of his peers in the same position in the Treasury Department.

According to the applicable legal system, could José Iglesias claim that he be paid the same salary that is paid to his new colleagues in the Department of the Treasury who perform the same functions as him?
