Problem: In considering the competency of evidence documentary evidence: 1- is not subject to the restrictive rules respecting relevancy materiality and competency as is oral testimony because it is unchanging evidence one it has been reduced to writing 2- must meet only the same rules regarding competency relevancy and materiality as testimonial evidence 3- there is little despite concerning competency because documents can be examined by all parties to the lawsuit 4- is subject to the same rules respecting relevancy and materiality as it oral testimony and in additional documentary evidence must be authenticated and comply with the best evidence rule in order to be considered competent evidence
