Problem: I am currently studying contract law, in my assignment I have a company being sued for breach of contract the company is arguing that a contract never existed because they believe that they did not by email make an offer to the plaintiff and that it was merely discussions. I need to show some defenses that the company may put forward. Is their some defenses I can use? For e.g could I use lack of mutual assent? And how would this apply or any other defenses?
