Classical and modern standards of criminalization


Here are the papers for my classes, each should be 2-4 pages in lenght.

1. Write a short paper on the following theme: “True or False: The Most Important Form of Justice is Corrective Justice.” In writing your paper be sure to give brief and clear descriptions of the three types of justice, and briefly give your reasons why you think corrective justice is or is not most fundamental.

2. Along with the assigned materials, read Dr. Martin Luther King, Jr.’s “Letter From Birmingham Jail” and answer the following question: Do you believe that a just person has a moral obligation to disobey an unjust law?

3. Cases that supposedly involve “victimless crimes” are sometimes today referred to as crimes against “public order”. Look at a famous example of such a case, Barnes v. Glen Theatre. In Barnes v. Glen Theatre, does the US Supreme Court accept or reject Mill’s Harm Principle?

4. Review the symposium on William F. Buckley’s famous article, “The War on Drugs is Lost” Do you agree with William F. Buckley, or disagree? How do classical and modern standards of criminalization apply? What results might occur related to these standards if legalization occurs?

5. Conduct research on the United States Supreme Court and on the highest court in a state of your own choosing. As part of your research, you s(?d visit the official website of the U.S. Supreme Court and the official website of your respective state. Compare and contrast the appointment and confirmation process of prospective United States Supreme Court justices with the process by which prospective justices are seated in your own state's highest court.

6. Monday Morning: Attorney John Forceful, Esq, managing attorney of a large firm in New Hampshire instructs James Legaleagle, new paralegal, that Legaleagle must conduct research into whether a charity raffle that will be run by a corporate client, that Friday, will run afoul of any laws that may prohibit or place limitations on sweepstakes or raffles. Legaleagle must produce his results in a memo for Forceful by the next morning. * Develop a short paper that explains the steps, research tools, artifacts (judicial reports, digests, legal periodicals, state and federal administrative law, etc) that Legaleagle will utilize to complete his memo by the deadline, including any other considerations to ensure accuracy.

7. Conduct research and identify an article in a scholarly journal or government site that provides information on a research study conducted that relates to your project topic.

8. Locate the Disciplinary Board which regulates the conduct of lawyers. For some links see the American Bar Association. Based upon your research of the Disciplinary Board, find a case where lawyers have been disciplined. Discuss the attorney’s actions, the discipline, and how ethics and justice were involved in the case.
