Problem
Jimmy Jones works on a big Hollywood studio lot. Jimmy's job is that of a set builder, using his carpentry skills to help erect lavish Hollywood sets. One day at work, Jimmy sees a man dressed in a Frankenstein costume choking a woman. The woman screams frantically for help. Concerned for her safety, Jimmy picks up his claw hammer and strikes the Frankenstein look-a-like over the head, killing him instantly. Jimmy is charged with 1st degree murder. Can Jimmy assert defense of others as a defense? Why or why not?
