Buyer bought a television from Wal-Mart. Wal-Mart failed to inform Buyer that the television had been a display model. The price was the same as it was for other televisions of that model which had not been display models. Buyer encountered major problems with the television and brought it back to Wal-Mart. Buyer informs Wal-Mart that he would like a new television, but the price is now $125.00 more. Wal-Mart indicates it will accept the television back, and refund the money Buyer spent, but nothing more.

Buyer has no damages as Wal-Mart took the television back , and refunded the purchase price.

Buyer is entitled to recover the price difference so that the Buyer can replace the television.

Wal-Mart's position is correct, if there was no other warranty.

Buyer is entitled to the return, but no additional damages.
