CLEANING LADY

Late one night, a businessman was working in his office when the cleaning lady walked in. It looked as though she was going to walk into an open metal filing cabinet drawer so the man put his hand out to stop her leg from hitting the cabinet. He didn't say anything. His hand touched her upper leg. She turned around and left without saying a word. The next day, his boss called him into his office and asked him why he had sexually harassed the cleaning lady. The businessman explained the situation. The businessman filed a defamation suit against her and the cleaning company. Was there defamation? Remember that there is a qualified privilege under public policy, i.e. it's in the best interests of the public to encourage rather than discourage this type of behavior.
