Best Energy Co. entered into separate written agreements with several coal companies. In each agreement, the coal company agreed to supply Best Energy with coal for the entire year in such amounts as Best Energy might desire to order, at a price of $41 per ton. In February Best Energy ordered 1,000 tons of coal from Sampson Coal Company, one of the parties that had signed an agreement with Best Energy. Sampson Coal delivered 700 tons and then notified Best Energy that it would not deliver any more, and denied any obligation under the contract. Sampson Coal filed a claim to collect $41 per ton for the 700 tons that it had delivered. Best Energy counterclaimed for damages of $2,200 for failure to deliver the additional 300 tons, and damages of $4,000 for breach of the agreement to deliver coal for the rest of the year.
