Problem
This arbitration agreement, which incorporates the American Arbitration Association Commercial Arbitration Rules, provides that each side is to select "a party-appointed" arbitrator and the two are to select a third neutral arbitrator. During the hearing, one of the party-appointed arbitrators announces he has had ex parte communications with the attorney and witnesses from the side that appointed him. Are such communications permissible under these circumstances?
